 HILEMAN REAL ESTATE, INC OCEAN PINES, MD LODGINGAGREEMENT 2018

1-OCEANPINES OFFICE HOURS: Monday-Saturday 9 AM to 5 PMand Sunday 10 AM to 3 PM.  

2-THE RENTALUNIT: Itis highly recommended that you preview the property prior to booking. The accommodations you have rented are privately owned and reflect the owner’s INDIVIDUAL tastes and needs.  The conditions of the property, as well as the furnishings vary according to the Owner’s preferences. Occupancy is limited to the number of people, including children, on Guest’s Lodging Agreement. The signing tenant (MUST BE AGE 25 AND OLDER)is financially responsible for any damages done to the leased property duringhis/her stay, whether made by him or herself, family or guests.  If for any reason, tenants becomeobjectionable, they may be evicted immediately, forfeiting all rent monies. TENANT MAY NOT SUBLET THE PROPERTY. THERE IS ABSOLUTELY NO SMOKINGPERMITTED IN ANY RENTAL PROPERTY.  

3-RESERVATIONSAND DEPOSITS: Call us toll free at 1-800-337-7368for reservations and inquires. Your reservation fees will include theweekly rental rate, 10.5% sales tax,and a $125.00 non-refundable processingfee. 30% of the rental amountwill be required to confirm the reservation. We accept Visa, MasterCard, andDiscover. The full amount of rent, taxes, and fees shall be paid in full thirty(30) days prior to check-in and Guest shall not be entitled to possessionunless and until said amount has been paid to the agent. Agent shall have thepower to declare the termination of this Lodging Agreement and forfeitures ofpayments made hereunder if the rent is not paid when it is due or if Guestgives Agent any check, draft, money order or change order for payment which isnot immediately collectable upon presentment. WE WILL NOT ACCEPT PERSONALCHECKS FOR RENT BALANCES LESS THAN 30 DAYS PRIOR TO CHECK IN.  Returned checks:  Agent will notify Guest bytelephone or mail of the returned check. Guest must provide a credit card,money order or certified/cashier check in the amount of the returned check plusa thirty ($30.00) dollar fee. The issue must be resolved within seventy-two(72) hours or the reservation will be canceled.

4-CANCELLATIONS:  -Should you find it necessary to cancel yourreservation, you may be subject to losing your entire rental amount. If we areable to completely re- rent your time slot to another guest at the same rate,you will be charged a 16% cancellation fee. If we are unable to re- rent yourtime slot completely, no refund will be issued. The owner or his agent reservesthe right to cancel any reservation at any time prior to occupancy, and will inthis event, refund any deposit received. 

5-CHECK-IN: CHECK IN IS BETWEEN 3:00 PM AND 5:00 PM (pending your property iscleaned and ready) at Hileman Real Estate, 11065 Cathell Road, Ocean Pines. If you areunable to arrive by 5:00 PM on Monday through Saturday, 3:00 PM on Sunday,please telephone our office to make arrangements. Guests who have not checkedin within 24 hours of the beginning of their reservation and have not notifiedHileman Real Estate of a delay, will forfeit all monies.

6-CHECK-OUT:  CHECKOUT IS PRIOR TO 10:00 AM AND IS STRICTLY ENFORCED. Before departing, PLEASE clean and put away all cooking and eating utensils, wipe off small appliances and countertops, remove all left-over food and supplies from the refrigerator and cupboards, fold and return blankets to the closet, return furniture to its original location, close drapes, close and lock windows, take all trash to curbside, dumpster, or trash chute and lock doors as you leave. Be careful not to remove any of the owner’s personal property.  

7-ACCIDENTALDAMAGE PROTECTION PROGRAM: In lieu of a securitydeposit, our properties offer a program to protect you from the expense ofaccidental damage to the premises during your stay. The $60.00 non-refundablefee protests you against accidental damage to your rented property, up to$1000.00 if reported during your stay. Accidental Damage coverage is includedin our balance due amount and you will be covered automatically. *Please review the complete description andunderstanding of the Accidental Damage Protection Program.   

8-PETS:  Pets are only permitted in “PET CONSIDERED” rentalproperties with prior approval from the owner and an additional $150.00. NON-REFUNDABLE PET DEPOSIT (PER PET).  The additional pet deposit that you have paidis only for the privilege of bringing your family pet(s) to the rental. Anydamage, excessive cleaning, yard clean-up or other damage related to yourpet(s) will be your additional responsibility. If you bring a pet to anyproperty, without permission, you will be asked to leave the propertyimmediately, your security deposit will be forfeited, and no monies will berefunded on your rental.                                                                                                                               

9-LOSTKEYS/LOCK OUT/LOST ITEMS:  YOU ARE RESPONSIBLE FOR REPLACING ANY LOSTKEYS. A $15.00 charge will be assessed for eachlost key. A lock out fee of fifty ($50.00) dollars will be charged to guestduring the hours that the rental office is closed, payable beforere-entry.  Hileman Real Estate is notresponsible for items left in a unit upon your departure. If we are able toretrieve a lost item, there will be a$15.00 minimum return fee, PLUSPOSTAGE.

10-GRILLS:  Provided in MOST (not all) Ocean Pines homes.Common courtesy: If you use it, please clean it. Please use caution and keepgrills away from the house during use. If the gas tank needs to be filledduring your stay, bring in receipt and you will be reimbursed. DO NOT GRILL ON SCREENED PORCHES,BALCONIES, OR CLOSE TO SIDING. Dispose of charcoal after it has cooled.

11- SWIMMINGPOOLS/FACILITIES:  Ocean Pines Club facilities are optional and are an additional cost.  Club membership office is 410-641-7717 Ext: 3018. Children of diaper age are not allowed inpools, per Maryland State Law. The opening and closing of pools is at the solediscretion of the Ocean Pines Association. Please observe pool rules andregulation. Information provided byHileman Real Estate is courtesy only.

12- PARKING:   Most Ocean Pines homes have parking fortwo/three cars. A parking permit is only required to park at the Ocean PinesBeach Club in Ocean City located between 49th & 50thstreets. One parking permit is included with the rental unit at check-in. Thispermit is for parking only, it does not grant you access to the pool orbathrooms at the Ocean Pines Beach Club. (Most of the Ocean Cityproperties require parking permits.) Replacementvalue could be as high as $100.00 for a lost or misplaced parking pass ifapplicable.  OCEAN PINES CLUB PRIVLEDGESARE AN ADDITIONAL COST!

13- REPAIRS:UPONYOUR ARRIVAL, YOU SHOULD NOTIFY US IMMEDIATELY OF ANY MISSING OR INOPERATIVE FURNISHINGSOR EQUIPMENT, OR OF ANY UNSAFE CONDITIONS THAT MAY RESULT IN AN INJURY.  EVERY EFFORT WILL BE MADE TO KEEP APPLIANCESIN GOOD WORKING ORDER.  SHOULDMAINTENANCE BE NECESSARY, WE WILL TRY TO REPAIR THE BREAKDOWN AS SOON ASPOSSIBLE AFTER BEING NOTIFIED.  WE CANNOTGUARANTEE THE OPERATION/CONDITION OF AIR CONDITIONERS, TELEVISIONS, APPLIANCES,AND INTERNET. NO REFUND OR RATE ADJUSTMENT WILL BE MADE FOR MECHANICALFAILURE.   

14-RENTAL SERVICE:  Arental service for cribs, high chairs, linens, beach equipment, etc. isavailable through local vendors. Please ask an agent for details. Someproperties offer linens and the cost is included in your rental cost amount.Feel free to contact our office to see if your home has linens included. Pleasekeep in mind there is no daily maid service. This service can be requested atan additional fee.   

15-LODGING TERMS: It is understood, mutually agreed and acknowledged bythe parties to this agreement that:

A.    Owner or Agent mayaccess the property at any time, at their sole discretion, for the purpose ofinspection, maintenance, cleaning, or repairs.

B.     Owner and/or hisauthorized agents, including without limitation, Agent, may terminate thisagreement and remove Guest at any time if, at the sole discretion of Ownerand/or his authorized agents, Guest becomes objectionable, violates any of theterms of this agreement, or violates any of the property rules and regulations.In such event, guest agrees to immediately vacate the property without refundand neither Owner nor is authorized agents, including, without limitation,Agent, shall be liable for any damages, including without limitations,incidental and consequential damages. 

16-AGENCYDISCLOSURE: We are required to notifyyou that, in a Real Estate transaction involving (rental) residential property,the listing broker, Hileman Real Estate, Inc. and its rental agents are paid bythe property owner.

DEFINITIONS:

1.     “Covered Guest”:  All registered guests and all persons sharing the same property, who have purchased the Accidental Damage Protection Plan and have paid the required plan cost.

2.     “Stay”: The stay and coverage take effect at a Hileman Real Estate property from the date of the Covered Guest’s check-in to the date of check-out. 

CONDITIONS:  The plan will not include liability fordamage or theft resulting from the following:

1.     Acts of God

2.     Intentional acts of a Covered Guest

3.     Gross negligence or willful and wanton conduct

4.     Any cause that the Covered guest does not reportthe damage to Hileman staff in writing during

Covered Guest stay

5.     Normal wear and tear

6.     Theft without a valid police report

7.     Damages caused by any pet or other animalbrought onto the premises by a Covered Guest

8.     This plan does not cover loss of use of thecovered property

9.     Property damage resulting from any motorizedvehicle or watercraft operated by a Covered Guest

10.  Coverage does not apply to theft or damage ofany property owned by or brought on to the premises by a Covered Guest.

11.  Loss of keys, parking passes and pool passes arenot included in the program

ADMINISTRATIVE PROCEDURES: All waivers of damage will be administered by Hileman Real Estatestaff.  Such staff will be the soleauthority to determine the nature and extent of the necessary repairs for thedamage protection.  The Covered Guestmust report any theft or damage to the property or its contents to Hileman RealEstate staff by the time of checkout, or any otherwise applicable damage waiverfor such Covered Guest will be void. 

Guests should be prepared to payfor any non-covered damage immediately by credit card or certified funds uponpresentation of the bill.

     THIS DOCUMENT BECOMES PART OF AND IS ATTACHED TO THE LODGING AGREEMENT.

TERMS OF THE PLAN:  As an enrolled Covered Guest under this plan, you will not be obligated to pay for damage to covered real or personal property of the owner of the rental property, located within the rental property, that is a result of your inadvertent acts during the duration of the stay. 

The maximum limit of this damage protection is $1000.00 per stay.

DEFINITIONS:

“Covered Guest”:  All registered guests and all persons sharing the same property, who have purchased the Accidental Damage Protection Plan and have paid the required plan cost.

“Stay”: The stay and coverage take effect at a Hileman Real Estate property from the date of the Covered Guest’s check-in to the date of check-out.

CONDITIONS:  The plan will not include liability for damage or theft resulting from the following:

Acts of God

Intentional acts of a Covered Guest

Gross negligence or willful and wanton conduct

Any cause that the Covered guest does not report the damage to Hileman staff in writing during
